Abstract

Subsidence due to underground mining creates deleterious effects to the surface properties and therefore becomes a matter of concern to land owners and general public. Damage to surface structures due to subsidence movements gives rise to public chaos and conflicts. The conflict can however be resolved by providing a balance between coal production and protection of environment by sound subsidence management or by compensation. For introducing and framing a suitable and significant compensation act in India the existing subsidence compensation act of three major countries, namely, United Kingdom, Pennsylvania (USA) and New South Wales (Australia) are reviewed. The paper encompasses a wide approach for the commencement and implementation of compensation act along with source of funding in India based on such worldwide established acts.
